Considering the legislation practice, defining the nature of real right, the author believes that real leasehold is usufruct of real property in nature. 綜合對各國關(guān)于不動(dòng)產(chǎn)租賃權的立法實(shí)踐,厘清不動(dòng)產(chǎn)租賃權的性質(zhì),對傳統的租賃權物權化進(jìn)行批判,還原租賃權的物質(zhì)本性,認為不動(dòng)產(chǎn)租賃權是用益物權。
